1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of ProductSights services. By accessing or using the Services, you agree to these Terms. If you use the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.

2. Accounts and Eligibility

You must provide accurate registration information and keep your account credentials secure. You are responsible for activities that occur under your account and for ensuring users in your workspace comply with these Terms.

3. Acceptable Use

You agree not to misuse the Services. Prohibited conduct includes:

• Violating applicable laws or regulations.
• Infringing intellectual property or other third-party rights.
• Interfering with system integrity, security, or performance.
• Attempting unauthorized access to accounts or infrastructure.
• Uploading malicious code, spam, or harmful content.

4. Subscriptions and Billing

Paid features may require a subscription. Unless otherwise stated, subscriptions renew automatically at the end of each billing period. Fees are non-refundable except as required by law or explicitly stated in your order form.

5. Customer Data

You retain ownership of data you submit to the Services. You grant us a limited license to host, process, transmit, and display that data solely to provide and improve the Services and perform our obligations under these Terms.

6. Intellectual Property

The Services, including software, design, trademarks, and documentation, are owned by ProductSights or its licensors and are protected by intellectual property laws. Except for rights expressly granted in these Terms, no additional rights are transferred to you.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the maximum extent permitted by law, ProductSights will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill. Our aggregate liability for claims related to the Services will not exceed amounts paid by you for the Services during the 12 months before the event giving rise to liability.

9. Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or to protect the Services and users. Sections that by nature should survive termination will survive.

10. Governing Law

These Terms are governed by applicable laws without regard to conflict-of-law principles. Any disputes will be resolved in the courts with proper jurisdiction, unless otherwise required by applicable law.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will post the updated version and revise the effective date. Continued use of the Services after the updated Terms become effective constitutes acceptance.
